Privacy Policy

Johnson City Housing Authority (“JCHA”) strives to protect the personal data and privacy of its tenants.  While JCHA takes all reasonable measures to protect tenants’ privacy, this Privacy Policy is not a contract and in no way creates a legal right against JCHA.  Rather, the following is a set of guidelines provided by JCHA for the protection of information provided to it by its tenants in making online credit card payments.

With respect to online transactions, this Privacy Policy applies to financial transactions between tenants and JCHA for purposes of lease-related payments (including, but not limited to, rent and late fees) by personal credit card.  JCHA utilizes services of third-party entities (such as Gateway, BancCard and Evalon) to ensure efficient and safe credit card processing.  Tenants should be aware that Privacy Policies of entities other than those of JCHA may contain materially different terms and in no way are the responsibility of JCHA.

Information Collected
We will not collect any personally identifiable information about you through the Web Site unless you provide it to us knowingly and voluntarily. JCHA collects personally identifiable information about tenants through our website and through offline transactions, such as in-person transactions or those made over the telephone.  Personally identifiable information includes, but is not limited to:  tenant name, address, phone number(s), credit card number(s), and email addresses.  In addition, when a tenant or someone on behalf of a tenant uses the JCHA website to make a rent payment, certain user information and site activity data may be collected.

We may automatically collect technical, non-personally-identifiable information when you visit the Web Site. Examples of this typr of information include your IP host address, the type of internet browser you are using, the type of computer operating system you are using, and the pages you view on the Web Site. We may use such information to improve the design and function of the Web Site or to help us improve services. We may at times share such information with unaffiliated third parties in an aggregated, anonymous form, which will not contain any personally identifiable information.

Credit Cards Accepted
JCHA currently accepts Visa and MasterCard credit cards for online rent payments.

Profile Information
When a tenant exercises the option to pay rent by online credit card payment, they are required to establish an online account to allow JCHA to link their existing JCHA file and current balance owed to the payment being made online.  In order to complete a tenant profile, the following information may be requested:  credit card type, number, billing date, card expiration date, telephone number(s) and an email address.

Tracking Technology
By using the JCHA website, some information may be automatically collected by our web servers as users navigate the site.  JCHA and our third-party service providers, some of which are listed above, also collect information by using technologies that enable tracking, such as ad tags, “cookies,” and web beacons. The Web Site may use session cookies to support navigation throughout the Web Site and for statistical analysis. Such session cookies are erased soon after the visit ends and are not collected or saved.

JCHA and its third-party service providers use cookies, ad tags and similar technical devices on our site (collectively “cookies”).  Cookies are used to help ensure users obtain the information requested and to authenticate a tenant’s authority to access the online payment aspect of the JCHA website.  It is important to note that if cookies are disabled in a user’s Web browser, some aspects of the site may not work properly.

Other Permitted Payment Options
Tenants are not required to use our online payment option to make rent payments.  Tenants may continue to use a “traditional” method, including personal check, certified check and money order, to pay rent and other lease-related expenses.  At any time, a tenant may discontinue use of the online credit card payment option and return to using “traditional” rent payment methods listed above.

Law Enforcement and Other Legal Processes
JCHA may disclose personal information in the following circumstances:  if required to do so by court order, state or federal law, subpoena or any other legal process; as requested by a law enforcement or governmental authority; to protect JCHA rights and/or property, its customers, and its website; or when otherwise advisable or necessary to do so.

Protection of Information Collected Electronically
JCHA maintains strict electronic, physical, and procedural safeguards to protect information and regularly reviews security standards to protect against any unauthorized access to tenants’ personal information.  When a tenant makes an online payment or accesses their account information, JCHA uses secure servers to protect sensitive information.  Although JCHA takes all reasonable steps to prevent unauthorized use of their website and personal information collected, it cannot be responsible for the acts of those who gain unauthorized access to personal information.  JCHA makes no warranties of any kind with regard to the prevention of unauthorized access to sensitive or personal information.

Privacy Policies of Other Websites
This Privacy Policy, which covers rent payments made by tenants of JCHA, only relates to and encompasses the JCHA website and does not, in any way, relate to unrelated sites or the sites of related third-parties.  JCHA has no control over these sites policies, and cannot dictate how they utilize information Internet users share with them.

JCHA Refund Policy
In limited circumstances such as duplicate payment and in its sole discretion, JCHA may issue a refund of rent payment or lease-related expenses made online by credit card.  Such refunds will be issued in the form of a credit to the same card initially charged.  Refunds will only be issued within ninety (90) days from the initial credit card payment, and will only be made after the tenant presents a receipt with the date and amount paid in the original transaction.  Refund may only be made if tenant has no past-due balance owed to JCHA.

Processing of credit card refunds may take several days, and could result in a delay in users being able to access refunded monetary funds.  Any such delay should be expected, and is not the responsibility of JCHA or any related third-party entities.

JCHA reserves the right to refuse a refund.  It also may, in its sole discretion, make a partial refund.


Changes to These Terms of Use

This Privacy Policy is not a contract and does not create any legal rights or obligations on the part of the user or JCHA.  Instead, this Privacy Policy simply reflects the guidelines setting forth JCHA’s intended business practices with regard to online credit card payments.  Users, however, consent to the collection and use of data and information provided through their use of the site to JCHA and its partners, affiliates and agents.  JCHA, in its sole discretion, may also amend, modify, interpret or delete any portion of this Privacy Policy at any time by posting an updated version.  Users’ continued use of the site shall be deemed acceptance of terms as posted at the time of use. A version of this Privacy Policy has been effective since December 1, 2014, and was last updated on December 1, 2014.

We reserve the right to change these Terms of Use at any time without prior notice by posting new Terms of Use at this location. Such changes shall be effective immediately upon posting. You agree to be bound by any such changes if you access or use the Web Site after they are posted.
